Legal sources said on the 31st that Judge Choi Ri-ji of the Daejeon District Court's Criminal Division 7 sentenced A, 21, who was indicted for violating the Child Welfare Act (child abandonment and neglect), to one year in prison, suspended for two years, and A's partner B, 20, to eight months in prison, suspended for two years.
A stood trial on charges of giving birth to the baby at around 7 p.m. on October 23 last year at her home in Yuseong District, Daejeon, then, together with B, leaving the baby in front of a nearby children's home at around 1:20 a.m. the next day. This was about six hours after the birth.
Investigators found that the two were residing in the country illegally and lacked the financial means to raise a child. They also found it burdensome that they had been unable to tell their parents about the pregnancy.
The court found that abandoning a newborn in cold weather was a serious offense. However, it took into account that A appeared to have been in a state of confusion after giving birth alone, and that after registering the birth, she continued to have visitation with the baby and showed an intention to raise the child.
