Could the Newly Established 'Korea Workers’ Compensation & Welfare Service Ulsan Hospital' Be Confused with the Existing 'Ulsan Hospital'?

[Financial News | Ulsan—Reporter Choi Su-sang] Despite an appeal from Ulsan Hospital, a midsize-to-large general hospital that opened more than 30 years ago, the name of KCOMWEL's specialized hospital for occupational accidents, scheduled to open next month in Beomseo-eup, Ulju County, Ulsan, has effectively been finalized as Ulsan Hospital. Although the court found no risk of confusion, circumstances could vary depending on what residents call the two hospitals.
According to legal sources on the 21st, the 22nd Civil Division of Ulsan District Court recently dismissed an injunction application filed by Ulsan Hospital, operated by Hyemyeongsim Medical Foundation in Sinjeong-dong, Nam District, Ulsan, against KCOMWEL. The application sought to prohibit the use of the trade name, among other relief.
Hyemyeongsim Medical Foundation filed the injunction in June, seeking to prevent KCOMWEL from using the name 'Ulsan Hospital' or any trade name containing it for its public hospital specializing in occupational accidents.
The foundation explained that it sought the injunction because Ulsan Hospital had already been operating in Nam District for about 30 years, and the establishment of a public hospital specializing in occupational accidents in Ulju County under the name 'Korea Workers’ Compensation & Welfare Service Ulsan Hospital' could cause confusion because the names are similar.
In particular, both hospitals have emergency rooms, raising concerns that communication errors among patients, emergency responders responsible for transportation, and medical staff could delay transfers or cause other problems during emergencies. Local residents also agreed with the concerns and supported the foundation by joining a petition drive.
However, the court determined that the names of the two hospitals were sufficiently distinguishable.
First, the court noted that 'Korea Workers’ Compensation & Welfare Service Ulsan Hospital' and 'Ulsan Hospital' differ in the number of characters making up their full names. It also found that users would perceive a public hospital specializing in occupational accidents and operated by a public institution differently from a general private hospital.
The court further determined that the trade name 'Ulsan Hospital' itself is a common combination of a geographic designation and a type of business, making it unreasonable for a particular entity to monopolize the name.
The court therefore concluded that the use of the name 'Korea Workers’ Compensation & Welfare Service' alongside the different symbols used by the two hospitals made it unlikely that the names would cause mistaken identity or confusion.
Despite the court's ruling, concerns have not subsided. Because 'Korea Workers’ Compensation & Welfare Service Ulsan Hospital' is relatively long, residents accustomed to shortening names may refer to it as 'Labor Hospital,' 'KCOMWEL Hospital,' or 'Corporation Hospital' instead of using its full official name. Some observers believe that if residents shorten it to 'Ulsan Hospital,' both speakers and listeners could become confused.
Meanwhile, 'Korea Workers’ Compensation & Welfare Service Ulsan Hospital,' the first public general hospital in Ulsan, is scheduled to open next month. The facility will have two basement levels, eight above-ground floors, 18 medical departments, and 290 to 300 beds.
