"Clothes never arrive, seller unreachable" ... Consumer alert issued over men's shopping mall 'Flyday'

[Financial News] Consumers have continued to suffer delivery delays and refund problems at the online men's clothing store Flyday (Pldi). The business operator is unreachable, prompting the Korea Consumer Agency (KCA) to urge caution when using the shopping mall.
The 1372 Consumer Counseling Network received a total of 102 consumer complaints related to Flyday from January through August this year, the KCA said on the 18th. Complaints have continued to arise since the first one was filed in December last year.
The most common complaint involved failure to fulfill a contract, with 48 cases (47.0%), followed by withdrawal from a contract with 37 cases (36.3%) and unjust enrichment with 11 cases (10.8%). Complaints related to contract nonperformance, including delivery delays, and contract withdrawals accounted for 83.3% of all cases, or 85 complaints.
Resolving the damage has also proved difficult. A total of 75 cases, or 73.5% of all complaints, were not resolved amicably because the business operator could not be reached or for similar reasons. They were instead handled by providing guidance on filing for damage relief or recording that no agreement had been reached.
One consumer purchased a matching top-and-bottom outfit last October but received only the bottoms. The business operator proposed replacing the out-of-stock top with another item, and the consumer accepted. However, delivery was delayed again, and the consumer ultimately requested a refund but never received one. Another consumer purchased 10 items of clothing and complained after some products failed to arrive. The business operator changed the order status to "cancellation completed" but did not refund the payment.
A notice informing the business operator of a damage-relief application, sent by the KCA to the registered business address, was returned because the recipient was unknown. Incheon City Hall and Geomdan-gu Office visited the registered address on the 2nd and confirmed that the business operator had already moved out. Geomdan-gu Office plans to proceed with administrative measures, including a corrective recommendation and the imposition of a fine for violating the E-Commerce Act.
A KCA official said, "When using Flyday, consumers should exercise caution when making purchases and keep records such as audio recordings, text messages and certified-mail documents that can prove the contract was not fulfilled." The official added, "When shopping online, use a credit card whenever possible, and be cautious of businesses that accept only cash payments or offer additional discounts for paying in cash."
