Man in his 20s convicted of molesting elementary school student receives suspended sentence in second trial as well

[Financial News] A man in his 20s who was brought to trial on charges of molesting an elementary school student he was tutoring was also given a suspended prison sentence in the appeals trial.
On the 10th, the Seoul Western District Court Criminal Appeals Division 1, presided over by Chief Judge Ban Jung-woo, dismissed both the prosecution's and Mr. Park's appeals in the appeals trial of Mr. Park, who was indicted on charges of quasi-forcible indecent assault of a minor.
Accordingly, the first-instance ruling sentencing Mr. Park to one year in prison, suspended for two years, was upheld. The order requiring him to complete 40 hours of sexual violence treatment programs and the five-year employment restriction at institutions related to children, adolescents, and persons with disabilities also remain in effect.
The court explained that the circumstances argued by both sides were "matters sufficiently considered by the lower court when determining the sentence."
Mr. Park was brought to trial on charges of molesting Ms. A, a tutoring student who was in the sixth grade of elementary school at the time, three times at the victim's home in March of last year.
Based on home security camera footage and other evidence, the first-instance court determined that Mr. Park had molested Ms. A three times. It found that Mr. Park continued the molestation even though Ms. A showed signs of refusal, such as trying to move away or stand up.
The case became controversial after being reported on a television program last April. The victim's side has been petitioning for severe punishment for Mr. Park.
Earlier, the prosecution requested in the appeals trial that Mr. Park be sentenced to two years in prison, the same sentence it sought in the first trial, stating, "The victim is petitioning for severe punishment, and the defendant is not seriously remorseful for his crime." Mr. Park's side admitted to all the charges in the appeals trial and requested leniency.
