[Financial News] A man in his 40s who went looking for his wife after she left home following an affair with a coworker said he is embroiled in a dispute over alleged stalking. He maintains that he only contacted and visited her because their elementary school-aged daughter was looking for her mother, and says he feels unfairly treated.
On the JTBC program “Sageonbanjang,” which aired on the 7th, the story was told of Mr. A, a man in his 40s who is raising his elementary school-aged daughter alone after divorcing his wife.
Mr. A married his wife, who was three years younger, about nine years ago after a brief courtship. She quit her job after giving birth and focused on raising their child. Last year, when their daughter started elementary school, she returned to work.
Mr. A said he began noticing something unusual after his wife started working. She began going on frequent business trips, and a selfie from a trip she said she had taken alone showed her coworker, Mr. B, alongside her.
Mr. A contacted Mr. B and asked about his relationship with his wife. Mr. B denied that they were involved and told him to come to his home and see for himself if he was suspicious. Although Mr. A’s wife tried to stop him, he went to Mr. B’s home after receiving his consent.
A cup identical to one used at Mr. A’s home was reportedly found at Mr. B’s house. Earrings that Mr. A had given his wife as an anniversary gift were also found under the bed. Mr. A said he felt wronged, claiming that his wife had even brought Mr. B ready-to-eat meals and other items from their home.
Mr. A later hired a specialist company to restore vehicle dashcam footage that his wife had deleted. The restored footage reportedly included a conversation between the two about sexual potency while they were in the car.
After evidence of the affair emerged, the wife left home, leaving their elementary school-aged daughter behind. Mr. A went with his daughter to his wife’s workplace several times, and also sent messages asking her to return for the sake of their child. However, the wife reportedly refused to meet him or respond and instead sought a divorce.
Mr. A divorced his wife by mutual agreement on the condition that he would receive custody of their daughter. He later filed a lawsuit against Mr. B, the affair partner.
Mr. B also reportedly made an outrageous remark during the lawsuit. Mr. A claimed that, while he and his wife were together, Mr. B said, “If you had kept a better eye on your wife, this never would have happened.” He said he felt devastated when his wife remained silent even after hearing the remark.
Mr. A won the lawsuit against the affair partner. However, the dispute has continued after his ex-wife claimed that his visits and messages during the period when she was away from home amounted to stalking.
Mr. A said he contacted and visited her because of their daughter. He appealed, saying, “My daughter was looking for her mother, so I contacted her and went to her workplace,” and added, “I’m worried that I could be punished for stalking because of this.”
A lawyer who appeared on the program said several factors must be considered when determining whether stalking has occurred. The lawyer explained, “To determine whether stalking has been committed, it is necessary to examine not only whether the person repeatedly contacted the other party against that person’s wishes, but also whether there was a legitimate reason and whether the conduct caused the other party anxiety or fear.”
The lawyer went on to say that it was unlikely Mr. A would face punishment. “His visits to his wife appear to have occurred after she left home, as part of his child’s efforts to find her mother. It does not appear highly likely that this would be treated as stalking and lead to punishment,” the lawyer said.
