Man Enters Stranger’s Home to Defecate After Getting Stomachache—What Did the Court Decide?

[Financial News] A man in his 50s who secretly entered someone else’s home and defecated there because he suddenly had a stomachache was fined 3 million won for trespassing. The homeowner discovered feces covered with toilet paper, checked the closed-circuit television (CCTV) footage, and reported the incident to police.
According to legal sources on the 6th, Presiding Judge Park Gwang-min of the Criminal Division 1 of the Cheongju District Court fined a man in his 50s, identified as A, 3 million won for trespassing. A was indicted for allegedly entering a detached house in Boeun-eup, Boeun-gun, Chungcheongbuk-do, at around 3:50 p.m. on December 31 last year.
A crossed the yard of the detached house and went to the area in front of the boiler room, where he defecated. Investigators found that A had been driving to meet his family nearby when he suddenly developed a stomachache and entered someone else’s home.
The homeowner found feces covered with toilet paper in front of the boiler room. After checking the CCTV footage and confirming that A had entered the property, the homeowner reported him to police.
A had previously served seven years in prison for robbery resulting in injury under the Act on the Aggravated Punishment of Specific Crimes and was released in October last year. After his release, he was sentenced to 10 months in prison for violating a probation order prohibiting him from drinking alcohol. He was incarcerated again in April this year and is currently serving that sentence.
Presiding Judge Park stated, "The sentence was determined after considering the defendant’s motive for the offense and the circumstances following the offense."
