Medytox Inc. Increases Damages Claim in Trade Secret Lawsuit Against Daewoong Pharmaceutical Co., Ltd. from KRW 50 Billion to KRW 500 Billion

[Financial News] Medytox Inc. has increased its claim for damages tenfold, from KRW 50 billion to KRW 500 billion, in the ongoing trade secret infringement lawsuit against Daewoong Pharmaceutical Co., Ltd.
Medytox Inc. announced on the 3rd that it had submitted an application to amend the claim and grounds for the claim in the appellate trial of its lawsuit against Daewoong Pharmaceutical Co., Ltd. and others seeking an injunction against trade secret infringement and damages, currently pending before the Seoul High Court.
The increase in the claimed amount reflects Daewoong Pharmaceutical Co., Ltd.'s sales volume and revenue from infringing products, which were additionally confirmed during the appellate proceedings. Medytox Inc. adjusted the scope of its claim by comprehensively considering sales data through July 31, 2025, the period for calculating damages, and the possibility of increased damages under relevant laws.
In particular, the provisions on increased damages under the Unfair Competition Prevention and Trade Secret Protection Act were also reflected. Under the Act, damages incurred after July 9, 2019, may be increased by up to three times, while damages incurred after August 21, 2024, may be increased by up to five times. However, whether increased damages will actually be awarded and the extent of any increase will be determined by the court.
Medytox Inc. claimed KRW 500 billion this time through an "explicit partial claim." This means that it initially claimed only part of the total potential damages calculated to date; damages incurred after August 1, 2025, were not included in the current claim.
Medytox Inc. plans to prove the damages resulting from the trade secret infringement based on additional materials during the future proceedings and continue taking legal action to protect its intellectual property rights.
"This amendment to the claimed amount reflects a realistic adjustment to the scope of the claim by incorporating the additional sales volume and revenue confirmed during the appellate proceedings, the extended period for calculating damages, and the relevant laws," a Medytox Inc. official said. "Because the strain and manufacturing process are core technological assets accumulated through long-term research, development, and investment, we will diligently present our arguments and evidence to protect the rights and interests of the company and its shareholders."
