Rehabilitation Court Delays Decision on Whether to Begin JTBC Restructuring Proceedings Until Next Month 30

[Financial News] The court has decided to postpone until next month 30 whether to begin restructuring proceedings for JTBC, which is facing liquidity problems.
The Rehabilitation Division 2 of the Seoul Bankruptcy Court, headed by Presiding Judge Jung Joon-young and with Judge Hong Jun-seo as the lead judge, accepted JTBC's request on the 30th to delay the decision on whether to open restructuring proceedings.
On the 15th, JTBC submitted an application for a restructuring proceeding and a separate request to delay the decision on whether to begin the process, telling the court that it hoped to pursue an Autonomous Restructuring Support (ARS) procedure. JTBC said it would use the ARS period to renegotiate its debt structure through voluntary talks with major financial creditors and prepare practical self-rescue measures.
The ARS system allows the court to suspend a decision on whether to open restructuring proceedings for a set period while the debtor and creditors negotiate a debt restructuring plan on their own. Its key purpose is to minimize damage to corporate value by allowing the debtor to lead the turnaround process instead of proceeding under a court-led restructuring. If the court approves an ARS request, it also issues a comprehensive stay order to block creditors' enforcement actions, and the start of restructuring proceedings can be delayed for up to three months. The court has initially given the company one month to allow as much voluntary negotiation time as possible.
The court said it made the decision after hearing the details of the voluntary restructuring plan and future steps at a hearing on the 23rd for representatives related to the JoongAng Group.
Going forward, the court plans to conduct an investigation into the debtor through an examiner before deciding whether to open restructuring proceedings, in line with its procedural rules. Hanyoung Accounting Corporation has been appointed as the examiner and will closely review the circumstances that led to the restructuring filing, the valuation of assets, and the company's going-concern value and liquidation value if the business continues.
The panel will receive regular reports on the progress and status of the ARS talks and will consider holding additional hearings if necessary.
If JTBC and its creditors reach an ARS agreement, the restructuring petition will be withdrawn and the debt will be repaid according to the agreed restructuring plan. If they fail to reach an agreement, the Rehabilitation Court will decide again whether to open proceedings based on the restructuring petition.
