[Financial News] A Brazilian woman indicted for repeatedly going to BTS member Jungkook's residence and stalking him received a suspended sentence at first trial. The court also considered charges of trespassing and violating a no-approach order.
On the 23rd, legal sources said that Park Ji-won, a chief judge at the Seoul Western District Court Criminal Single-Judge Division 1, sentenced the Brazilian woman, identified as A, to one year in prison with a two-year suspended sentence early last month for violating the anti-stalking law and trespassing.
Investigators found that A's stalking continued from December 7 to December 28 last year. During that period, she allegedly visited Jungkook's home in Seoul 22 times and loitered or watched around the area, causing the victim anxiety and fear.
The acts were also repeated in specific ways. On the first day of the offense, A rang the doorbell 13 times in a row over about 20 minutes. On December 13, she is believed to have entered the home while a delivery worker was coming and going.
Police arrested A in the act and issued an emergency protective order barring her from approaching Jungkook or his home within 100 meters.
Even after the no-approach order, A was found to have returned to Jungkook's home. She was also charged with violating the emergency protective order on January 4, when she left photos and printed materials near the residence.
Judge Park said, "After the defendant was caught in the act, warned by police during questioning, and released, she still committed stalking offenses." He added, "The victim wants the defendant to be severely punished."
However, the court also took into account its view that A appeared to have acted in order to express her feelings to Jungkook and had no intent to cause harm. The sentence also reflected the relatively minor nature of the violation of the emergency order and the fact that she did not break into the interior living space.
The court also considered that A had been detained for about three months in connection with the case and that she would face deportation after the ruling became final.
