The IT Crime Investigation Division of the Seoul Central District Prosecutors’ Office, led by chief prosecutor Park Kyung-taek, announced on the 9th that it had indicted without detention a former Samsung Electronics IP Center employee, Mr. C (59), two employees of the patent monetization firm Ideahub, a Non-Practicing Entity (NPE), and the corporate entity Ideahub on charges of violating the Unfair Competition Prevention Act. The division also filed additional charges of forgery of private documents and use of forged private documents against Mr. A (54), a former senior engineer at the Samsung Electronics IP Center who had been indicted and detained on December 2, and additionally indicted Ideahub operator Mr. B (56) for violating the Unfair Competition Prevention Act.
According to the prosecution service, an NPE is a patent monetization firm that does not operate manufacturing facilities but instead generates profit by selling its patents or collecting license fees from manufacturers and other companies. Ideahub approached Samsung Electronics seeking to sign an agreement on ownership and usage rights for IP Center patents, then contacted Mr. A and obtained internal analysis materials from Samsung Electronics regarding Ideahub’s proposal. These materials are believed to have contained information on patents that Samsung Electronics was considering purchasing or licensing, as well as strategies for responding to potential legal disputes.
In this process, Mr. C is accused of passing internal materials to Mr. A, even though he knew they would ultimately be delivered to Mr. B, after receiving a request from Mr. A. Mr. D and Mr. E are accused of analyzing internal Samsung Electronics documents that Mr. B had illegally obtained. The prosecution service also uncovered that Mr. A allegedly forged a "foreign currency deposit confirmation" and submitted it to the Samsung Electronics audit team to conceal the fact that he had received 1 million dollars from Mr. B, while Mr. B is additionally suspected of leaking internal reports to his subordinates, Mr. D and Mr. E.
A representative of the prosecution service stated, "As domestic companies such as Samsung, LG Corporation, and SK Group have emerged as leaders in advanced technology fields like semiconductors, IT, and batteries, they have become prime targets for overseas NPEs," adding, "There are growing concerns that a lukewarm response to illegal activities by NPEs could undermine the technological competitiveness of Korea’s key industries, including semiconductors, IT, and batteries, so we will move swiftly by drawing on our accumulated investigative expertise."
