According to the legal community on the 27th, Criminal Division 13 of the Seoul Southern District Court, presided over by Judge Kim Sang-yeon, sentenced Mr. A, a man in his 30s, to three years in prison after he was tried by a Korean Jury Trial on charges of quasi-rape.
Mr. A was accused of raping Ms. B after carrying her to a nearby hotel when the two were left alone in a karaoke room following a drinking session with an exercise group in August last year.
Mr. A claimed, "Ms. B was not intoxicated at the time, and after the incident, we drank together and had physical contact again," insisting that the sexual intercourse on the day of the incident was consensual.
The Seoul Southern District Prosecutors' Office stated that it protected Ms. B through separate questioning and clarified her testimony using visual aids during witness examination, while also challenging the credibility of Mr. A's witnesses.
The prosecution actively argued that Mr. A's claim that sexual assault victims must behave in a certain way after the incident presupposes a 'victim stereotype.'
The jury, consisting of seven members, deliberated for four hours and found Mr. A guilty by a vote of 5 to 2. The court accepted the verdict, sentenced Mr. A to three years in prison, and took him into custody in the courtroom.
A prosecution official stated, "We will respond strictly to sex crimes that destroy victims' lives and do our utmost to ensure that sentences are commensurate with the crime."
