Kim Keon Hee’s Side Files Petition with Korean Bar Association... “Broadcasting Special Prosecutor’s Investigation Footage Is Illegal”

[Financial News] The legal team representing Kim Keon Hee, wife of former President Yoon Suk Yeol, has submitted a petition to the Korean Bar Association (KBA) regarding allegations that the Special Prosecutor’s team led by Min Joong-ki filmed the investigation without consent and broadcast the footage in real time.
According to legal sources on the 20th, Kim Keon Hee’s attorneys filed a petition with the Committee for the Protection of Lawyers' Rights under the KBA earlier that morning, arguing that "filming a suspect’s interrogation without prior notice is illegal" and requesting a fact-finding investigation into the Special Prosecutor’s actions.
In the petition, the legal team stated, "The Criminal Procedure Act contains no provisions regarding the real-time broadcasting of suspect interrogations," and asserted, "Such actions by the Special Prosecutor are a clear abuse of authority not stipulated by law and are therefore illegal."
They further pointed out, "Even if the Special Prosecutor’s real-time broadcasting of the interrogation is considered ‘video recording’ under the Criminal Procedure Act, Article 224-2 of the Act requires that the suspect be informed if their statement is being recorded on video."
Additionally, Kim Keon Hee’s side claimed that the Special Prosecutor restricted the participation rights of defense counsel during the investigation. They alleged that during the investigation conducted from August 5 to 25, some prosecutors made defense attorneys sit behind Kim Keon Hee, effectively limiting their ability to participate.
Furthermore, they added that the Special Prosecutor prevented objections to the questioning method during the investigation, and these objections were not reflected in the official records.
The Committee for the Protection of Lawyers' Rights under the KBA is an organization that investigates and addresses cases where lawyers’ rights are infringed upon or they are treated unfairly by courts, prosecutors, or other institutions. If the committee reports the matter and the association president determines the case is serious and members’ rights have been violated, necessary measures may be taken.
A KBA official stated, "The petition was received today, and it is expected to take some time for the committee to review and reach a conclusion."
