[Financial News] The government is working on measures to recover criminal proceeds generated from crimes committed in the Kingdom of Cambodia and bring them back to Korea.
According to relevant government agencies on the 20th, the Ministry of Justice (MOJ) is seeking ways, in consultation with the government of the Kingdom of Cambodia, to recover criminal proceeds earned by Cambodian criminal organizations from Korean nationals.
If the MOJ, through the Ministry of Foreign Affairs, requests the Kingdom of Cambodia to identify crime victims and the amount of damages, the authorities in Cambodia will investigate and recover the proceeds, which will then be repatriated to Korea. This process is currently under review.
The government plans to prioritize requesting investigations into Cambodian crime cases currently under investigation or trial in Korea. If a guilty verdict is reached, the amount of damages will be specified and requested for recovery.
Under the Treaty on Mutual Legal Assistance in Criminal Matters (MLAT), if the victim resides in Korea and the amount of damages is specified, the government can request the recovery of criminal proceeds, even if the crime was committed abroad.
Korea signed the Treaty on Mutual Legal Assistance in Criminal Matters with the Kingdom of Cambodia in 2019, and it entered into force in 2021.
