Lee Jin-sook’s Constitutional Petition Against ‘KMCC Establishment Act’ to Be Formally Reviewed by Constitutional Court

[Financial News] Former KCC Chairperson Lee Jin-sook has filed a constitutional petition, claiming that the Act on the Establishment of the Broadcasting, Media and Communications Commission, which abolishes the KCC and establishes the Korea Media and Communications Commission (KMCC), is unconstitutional. The petition will now be formally reviewed by the Constitutional Court of Korea.
According to legal sources on the 17th, the Constitutional Court of Korea referred Lee’s petition challenging Article 4 of the Act on the Establishment of the Broadcasting, Media and Communications Commission to a formal hearing on the 15th. The designated panel reviewed the legal requirements on the 13th and, two days later, transferred the case to the full bench.
Under the Constitutional Court Act, a designated panel of three justices first examines whether a constitutional petition meets legal requirements. If the panel finds no procedural flaws, the case is forwarded to the full bench of nine justices for deliberation.
The disputed Article 4 of the Act on the Establishment of the Broadcasting, Media and Communications Commission stipulates that employees of the former KCC are to be transferred to the KMCC, but excludes political appointees.
Lee Jin-sook argued that this provision shortens her term, which was guaranteed until August next year, thereby violating her rights to equality, the pursuit of happiness, and public office. She filed a constitutional petition and also requested an injunction to suspend the law’s effect.
The Act on the Establishment of the Broadcasting, Media and Communications Commission, which passed the plenary session of the National Assembly of the Republic of Korea on the 27th of last month, took effect on the 1st of this month. The former KCC was dissolved, and the KMCC was officially launched. Lee Jin-sook was dismissed on the same day in accordance with the new law.
