[Financial News] A former police officer accused of raping a minor has been sentenced to 3 years in prison in the first trial.
According to the legal community on the 23rd, the Seoul Northern District Court's Criminal Agreement Division 13 (Chief Judge Na Sang-hoon) sentenced Mr. Kim (32), who was indicted on charges including the Youth Protection Act (production of sexual exploitation materials), to 3 years in prison. He was also ordered to complete a 40-hour sexual violence treatment program and was banned from employment in child, youth, and disabled-related institutions for 5 years.
The court considered the victim's lack of desire for punishment as a favorable condition for Mr. Kim. The court explained, "The victim expressed the intention to receive the deposit money after becoming an adult and stated that they do not wish for further severe criminal punishment," adding, "The victim's expression of such intention is a favorable condition for the defendant."
However, Mr. Kim was sentenced to imprisonment. The court stated, "Considering that the victim is a minor, the crime was not known to the victim's family due to various circumstances, and most importantly, the defendant committed such an offense despite having a profession that should protect minors, the responsibility is very heavy," and "Punishment corresponding to the responsibility is inevitable."
Mr. Kim, who was a sergeant at the Incheon Nonhyeon Police Station precinct, was brought to trial on charges of committing a sexual assault against a youth he contacted through social networking services (SNS) in July last year and filming it with a mobile phone. It is reported that the police held a disciplinary committee and decided on the highest level of discipline, dismissal.
During the trial, Mr. Kim sobbed throughout the sentencing. Upon being sentenced to imprisonment, he covered his face and wiped away tears before leaving the courtroom.
He submitted several letters of reflection to the court, containing stories about his newborn child and family.
Last month, the prosecution requested the court to sentence Mr. Kim to 7 years in prison, order him to attend a sexual violence treatment program, disclose and notify his personal information, and impose a 10-year employment restriction in child, youth, and disabled-related institutions. Mr. Kim admitted to the charges in the first trial.jyseo@fnnews.com Seo Ji-yoon Reporter
