[Financial News] The special prosecutor team for rebellion and foreign affairs (Cho Eun-seok Special Prosecutor) will proceed with a bail hearing on the 26th for the case where former President Yoon Seok-yeol was additionally indicted. It is noteworthy whether former President Yoon, who has not attended the trial since being re-detained, will appear in person to discuss the necessity of bail.
According to the legal community on the 23rd, the 35th Criminal Division of the Seoul Central District Court (Presiding Judge Baek Dae-hyun) has decided to hold a bail hearing for former President Yoon, who was indicted on charges including obstruction of special official duties, on the 26th at 10:30 AM.
Former President Yoon's side applied for bail to the court on the 19th. Bail is a system that releases the defendant by suspending the execution of detention on the condition of paying a deposit. It is known that former President Yoon's side argued that bail is necessary to guarantee the right to defense due to health issues.
Former President Yoon was released by the decision to cancel detention by the 25th Criminal Division (Presiding Judge Ji Gui-yeon) reviewing the rebellion leader case in March, but was re-detained in July following the issuance of a detention warrant requested by the special prosecutor team. At that time, former President Yoon's side filed a detention review claiming the detention was unjust, but the court did not accept it.
The court plans to hold the first trial date of this case at 10:15 AM on the same day and then proceed with the bail hearing immediately. Former President Yoon is obligated to attend from the trial date, but his attendance is uncertain as he has recently been absent from the rebellion charge case. However, since a bail hearing is scheduled this time, there is interest in whether he will appear in person to explain the necessity of a trial without detention.
Earlier, at the trial preparation date on the 19th of last month, the court asked former President Yoon's side, "Is it difficult for the defendant to attend court due to health conditions?" In response, the defense team answered, "It is difficult to sit in the same place for a long time in the current health condition," and "We are continuously checking the health through meetings and plan to attend the trial depending on the situation."
Former President Yoon is facing five charges, including infringement of the martial law review and decision-making rights of cabinet members, post-drafting and disposal of the martial law proclamation, false public relations after the emergency martial law, instruction to delete secret phone records, and obstruction of arrest warrant execution.
