Accused of Abuse of Authority and Neglect of Duty
Former Prosecutor General Sim appeared at the Seoul High Prosecutors' Office, where the Special Prosecutor's Office is located, at around 9:54 a.m. on the 21st. He did not respond to reporters' questions about his position on the 'decision to waive the immediate appeal of former President Yoon Seok-yeol's arrest cancellation' and whether he received instructions to dispatch prosecutors to former Minister of Justice Park Sung-jae during the emergency martial law, and headed to the investigation room.
The Democratic Party and civic groups filed a complaint with the High-ranking Officials' Crime Investigation Office (Gongsoocheo) last March, accusing former Prosecutor General Sim of abuse of authority and neglect of duty for not filing an immediate appeal after the decision to cancel the arrest of former President Yoon. Gongsoocheo determined that this was included in the scope of the special prosecutor's investigation and handed over the case to the special prosecutor.
Last March, former President Yoon, who was indicted on charges of being the leader of the rebellion, claimed that the prosecution's indictment was made after the detention period expired and filed for cancellation of the arrest with the court, which was accepted. The court ruled that it is reasonable to calculate the detention period in 'hours' rather than 'days', and judged that the prosecution proceeded with the indictment against former President Yoon after the detention period had expired.
The special prosecutor's team is expected to confirm the facts of the overall suspicions against former Prosecutor General Sim. Previously, the special prosecutor's team conducted a search and seizure of former Prosecutor General Sim's mobile phone and the Supreme Prosecutors' Office on the 25th of last month to secure evidence to clarify the truth of the related suspicions.
