The Korean Patent Attorneys Association held a relay one-person protest in front of the National Assembly at 10 a.m. on the 2nd, urging the swift passage of the Patent Attorney Act amendment (proposed by Assemblyman Kim Jeongho), which primarily involves representation in patent infringement lawsuits by patent attorneys.
The Patent Attorney Act amendment, which primarily involves joint representation by patent attorneys and lawyers in patent infringement lawsuits, has been proposed in the National Assembly six consecutive times from the 17th to the 22nd National Assembly but has repeatedly failed to pass the threshold of the National Assembly's Judiciary Committee.
In the one-person protest that day, Chairman Kim Dukyu stated, "This year marks the 20th year since the Patent Attorney Act amendment was proposed in the National Assembly," and "I came to the National Assembly with the hope that the amendment will definitely pass in the 22nd National Assembly to resolve the long-standing wishes of the science and technology and industrial sectors."
Chairman Kim emphasized, "Under the current government, policies to strengthen Korea's intellectual property competitiveness, such as the promotion of the Intellectual Property Office and the introduction of the K-Discovery system, are emerging," and "To achieve results from these systems, it is urgent to strengthen intellectual property protection capabilities, and for this, the introduction of joint representation by patent attorneys and lawyers must be resolved." He also stated, "Nine out of ten small and medium-sized enterprises in Korea give up lawsuits even if they suffer patent infringement," and "To improve this reality, not only the K-Discovery system but also joint representation by patent attorneys and lawyers, and policies that can enhance the expertise of courts, such as the introduction of a technical judge system, must be introduced and operated together."
Meanwhile, in the 22nd National Assembly, two amendments to the Patent Attorney Act, primarily involving representation in patent infringement lawsuits (proposed by Assemblymen Kim Jeongho and Kwon Chilsung, both from the Democratic Party of Korea), are pending in the Industry, Trade, and Energy Committee.
