Kim Geon-hee Special Prosecutor Team, Charged with Violating Political Funds Act, Requested Arrest Warrant on 28th Last Month
[Financial News] The Ministry of Justice has submitted an arrest request to the National Assembly for Kwon Seong-dong, a member of the People Power Party, who has been charged with violating the Political Funds Act.
The Ministry of Justice announced on the 1st, "In relation to the charges of violating the Political Funds Act against Representative Kwon, we have submitted an arrest request to the National Assembly following the request of a judge from the Seoul Central District Court."
The Kim Geon-hee Special Prosecutor Team (Min Jung-gi Special Prosecutor) requested an arrest warrant for Representative Kwon on the 28th of last month on charges of violating the Political Funds Act, and the Seoul Central District Court delivered the arrest request to the special prosecutor team the next day.
To hold a pre-arrest interrogation (warrant review) for a sitting member of the National Assembly, the court must receive an arrest consent from the National Assembly. According to Article 44 of the Constitution, a member of the National Assembly cannot be arrested or detained without the consent of the National Assembly during a session, except in cases of flagrant offenses.
The Speaker of the National Assembly must report the arrest request to the plenary session after receiving it, and a vote must be held within 72 hours after 24 hours from the time of the report. However, if the arrest consent is not voted on within 72 hours, it is submitted to the first plenary session convened thereafter for a vote. The arrest consent is passed with the attendance of a majority of registered members and the approval of a majority of present members. If passed, the date for the warrant review is set, and if rejected, the court dismisses the warrant without review.
Representative Kwon is accused of receiving 100 million won (violation of the Political Funds Act) in exchange for providing votes, organization, and finances of Unification Church members in the 20th presidential election from Yoon Mo (indicted and detained), the former head of the Unification Church World Headquarters, with a request to promote Unification Church issues as national policy after Yoon's election as president.
There are also suspicions that in February to March 2022, he received a shopping bag containing cash from Han Hak-ja, the president of the Unification Church, and leaked police investigation information about Han's overseas gambling to the Unification Church to prepare for the investigation.
The special prosecutor team is also investigating allegations that Yoon and "Geonjin Beopsa" Jeon Seong-bae mobilized Unification Church members to join en masse to support Representative Kwon in the People Power Party's leadership election held in March 2023.
