[Financial News] The National Assembly Legislation and Judiciary Committee (Legislation and Judiciary Committee) visited Seoul Detention Center, where former President Yoon Seok-yeol is imprisoned, to check closed-circuit (CC)TV footage, to which former President Yoon's side strongly objected, calling it an "illegal act."
Former President Yoon's legal representatives issued a statement on the 1st, claiming that "the Legislation and Judiciary Committee's viewing of Seoul Detention Center CCTV violates the Penal Execution Act, Information Disclosure Act, Personal Information Protection Act, etc."
The representatives stated, "Article 94 of the Act on the Execution of Sentences and Treatment of Prisoners allows the use of CCTV for surveillance within the necessary scope to prevent acts that harm the life or body of prisoners, such as suicide, self-harm, escape, assault, damage, or other acts that harm the safety or order of facilities," and pointed out that "it is not to be used or viewed to confirm the provision of privileges or obstruction of investigation as decided by the National Assembly."
They further explained, "The internal CCTV of correctional facilities is subject to a principle of non-disclosure as it is a security facility video, not only to protect the human rights of prisoners but also because exposure of the internal structure or security system of correctional facilities can pose a significant security risk."
As such, since CCTV viewing is not possible except in exceptional situations, the Legislation and Judiciary Committee's viewing of the footage is claimed to be illegal.
The representatives emphasized, "Viewing and disclosing CCTV footage installed for the safety of prisoners and maintenance of facility order to confirm allegations of privilege provision and investigation obstruction clearly violates the purpose of the relevant laws," and "the legal judgment on the illegality of the arrest is the domain of the judiciary and is not a matter of the public's right to know."
They added, "While refusing even the information disclosure requested by the party to secure evidence of illegality, the National Assembly, which is neither an investigative agency nor a court, claiming to verify this is no different from saying that the law can be violated for political purposes," and "the decision of the National Assembly Legislation and Judiciary Committee, which violates the legal framework of penal execution and public institution information disclosure to humiliate a former president, is clearly illegal."
On this day, members of the Democratic Party of Korea and the National Innovation Party belonging to the Legislation and Judiciary Committee visited Seoul Detention Center in the morning to conduct on-site verification to confirm whether privileges were provided to former President Yoon during his imprisonment. It is reported that they also viewed CCTV and other video records showing former President Yoon resisting during the special prosecutor team's attempt to execute an arrest warrant last month.
This on-site verification follows the decision made by the Legislation and Judiciary Committee on the 26th of last month to adopt the 'On-site Verification Implementation Plan.'
