Both Defendant and Prosecution Appeal, Resulting in 'Cross Appeal'
[Financial News] A man in his 70s, sentenced to 15 years in prison in the first trial for murdering his wife who demanded a divorce during separation, has appealed the verdict.
According to the legal community on the 31st, Mr. Joo, a man in his 70s who was tried for charges including murder, submitted an appeal to the Seoul Southern District Court on the 21st. On the same day, the prosecution also submitted an appeal to the court, resulting in a cross appeal.
Mr. Joo was indicted for assaulting and killing his wife in her 60s at their home in Doksan-dong, Geumcheon-gu, Seoul, around 2:30 PM on March 3rd. It was investigated that he locked the door and continued the assault after his wife said, "I will divorce," eventually causing her death by pressing her neck with his foot.
In the prior sentencing trial held last month, the prosecution demanded a 30-year prison sentence for Mr. Joo.
However, Mr. Joo's lawyer pleaded for leniency from the court, stating, "The defendant acknowledges all the crimes and sincerely repents," and "Considering that he has faithfully fulfilled his role as a spouse and head of the family, has no criminal record, and is suffering from diabetes and hypertension due to old age, please take these into account comprehensively."
The first trial court stated, "Murder is clearly a serious crime that takes another person's life," and "Considering the means, method, and result of this crime, the nature of the crime is not good, and there are some doubts about whether the defendant is sincerely remorseful," and sentenced him to 15 years in prison.
