[Financial News] The court has suspended the enforcement of damages in the first trial ruling that ordered former President Yoon Seok-yeol to compensate for mental damages caused by the declaration of martial law. Former President Yoon is not required to pay the damages until the appeal verdict, provided he deposits 100,000 won per person.
According to the legal community on the 12th, the Civil Appeal Division 8-3 of the Seoul Central District Court (Judges Shin Young-hee, Jeong In-jae, Kim Ki-hyun) accepted the application for suspension of enforcement filed by former President Yoon. However, the court decided to suspend the enforcement until the appeal verdict, on the condition that former President Yoon deposits 100,000 won as collateral for each respondent (citizens).
Previously, on the 25th of last month, Chief Judge Lee Seong-bok of the Seoul Central District Court Civil Division 2 ordered former President Yoon to compensate 104 citizens with 100,000 won each in a damages lawsuit.
This ruling included a 'provisional execution' order, which allows for the enforcement of the compensation amount and 12% annual interest even before the ruling is finalized. Generally, enforcement is only possible after the ruling is finalized, but the court can allow provisional execution if it deems that prompt realization of rights is necessary.
Once a ruling with provisional execution is delivered, it immediately gains enforceability, allowing the winning party to enforce the ruling, such as seizing the losing party's assets, even if an appeal is filed.
In response, former President Yoon's side applied for suspension of enforcement to prevent provisional execution, and if the court accepts it, enforcement will not occur until the designated deadline.
It is commonly known that suspension of enforcement is often granted on the condition of providing collateral, such as cash deposits or surety insurance certificates.
