[Financial News] The Ministry of Justice is reducing the scope of prosecutors' direct investigation initiation rights.
The Ministry of Justice announced on the 8th through a press release, "Before the full-fledged legislative reform of the prosecution, it is necessary to prepare and implement regulations on the initiation of investigations by prosecutors that align with the intent of the current Prosecutors' Office Act," and stated, "Minister Jeong Seong-ho of the Ministry of Justice has instructed the immediate promotion of the amendment work of the investigation initiation regulations."
''The Ministry of Justice plans to amend the investigation initiation regulations, which are related enforcement ordinances, in accordance with the legislative intent of the Prosecutors' Office Act, which limits the scope of prosecutors' direct investigation initiation rights to major crimes such as corruption and economic crimes. The direct investigation initiation rights of prosecutors have been pointed out as causes of excessive investigations, lenient investigations, and command investigations, leading to the abuse of prosecutorial power.
A Ministry of Justice official stated, "Through the amendment of the enforcement ordinance that aligns with the intent of the amendment, it is expected to faithfully reflect the will of the sovereign people in the operation of the prosecution system and prevent unreasonable investigations by prosecutors based on enforcement ordinances that broadly define the crimes subject to investigation initiation by prosecutors, thus becoming the first step in normalizing the prosecution."
