Violation of Article 100 of the Penal Execution Act
Yoon's legal representatives, Bae Bo-yoon and Song Jin-ho, held a press conference in front of the Seoul High Prosecutors' Office on this day, claiming that the special prosecutor team used physical force, such as grabbing Yoon's limbs, during the process of executing the arrest warrant, causing Yoon physical pain.
The legal team explained, "About 10 people tried to grab both arms and legs of former President Yoon, who was sitting, and tried to put him in the vehicle," and "When former President Yoon strongly resisted, they tried to lift him while he was still sitting in the chair, and in the process, the chair slipped back, causing former President Yoon to fall to the ground."
They added, "Former President Yoon's back also hit the chair leg, and he said, 'It feels like my arm is going to come out,' and pleaded, 'Please let me go.'"
They claimed that the execution of the warrant by the special prosecutor team was illegal. They argued that physical force can only be used on detainees in the seven cases stipulated in Article 100 of the Penal Execution Act, and that former President Yoon's case did not fall under these seven cases. They also cited Article 81, Paragraph 3 of the Criminal Procedure Act, which states that "the execution of a warrant is carried out by a prison officer under the direction of a prosecutor."
They also claimed that the attempt to forcibly detain a detainee using physical force was unprecedented. The legal team said, "(During the Park Geun-hye administration's state affairs manipulation case) it was known that physical force was used during the forced detention of Choi Soon-sil, but in Choi's case, the prison officer persuaded her, and she voluntarily came out."
They continued, "The suspect's interrogation is a voluntary investigation, but even though they were notified in advance that they would not comply, trying to forcibly detain them physically is tantamount to forcing a statement," and "it is a criminal coercion and, in itself, an act of abuse."
The legal team concluded by saying, "Measures in the criminal justice system should be carried out with the minimum necessary according to the procedures defined by the Constitution and laws," and "We hope that such human rights-violating measures and actions will not be repeated in the future for the sake of the human rights of all inmates nationwide, as well as those facing criminal punishment."
