Police request active interpretation of 'recurrence concern' for provisional measures
According to the police on the 6th, the National Police Agency, Supreme Prosecutors' Office, Ministry of Justice, and Ministry of Gender Equality and Family held a 'Stalking Crime Response Council' at 2 PM at the National Police Agency in Seodaemun-gu, Seoul.
Recently, the need for response has increased as incidents continue, such as stalking perpetrators committing murder after provisional measures were dismissed by the prosecution. The police and prosecution have held five related meetings since September 2022. This is the first time the Ministry of Justice and Ministry of Gender Equality and Family have participated in the council.
The police requested cooperation, stating that victim protection has been insufficient as provisional measures have been repeatedly dismissed by the prosecution. They emphasized the need to actively interpret the requirement of 'recurrence concern' for provisional measures. They also explained the need to assess 'risk of reoffending' concerning 'concern of evidence destruction,' a reason for detention.
They requested that changes to provisional measures be notified to the police to maintain the separation of perpetrators even after transfer. The police stated that they are experiencing difficulties in protecting victims as changes to provisional measures are not shared with the police.
The prosecution requested that the police ensure no omission of report details when applying for provisional measures and promptly supplement records. The Ministry of Justice emphasized the active use of electronic devices in cases where there is a concern of reoffending in stalking crimes. The Ministry of Gender Equality and Family requested active linkage to victim support institutions (1366) for 112 reports and shared support details.
Previously, incidents where victims who reported stalking to the police were killed or nearly killed by perpetrators occurred repeatedly. In both the Uijeongbu stalking murder case and the Ulsan stalking attempted murder case, the police applied for provisional measures, but the prosecution did not accept them. It was also revealed that the Ulsan stalking suspect violated emergency measures. Emergency measures are a system where the police order restrictions such as no contact without court approval and receive post-approval.
Park Woo-hyun, acting director of the Criminal Bureau, said, "In relational crimes, swift and meticulous response is crucial from the perspective of victim protection," and "We will closely cooperate by establishing a constant cooperation system with related departments for inter-agency collaboration."
