[Financial News] The Supreme Court panel that will handle the so-called 'corporate card misuse' case involving Mrs. Kim Hye-kyung, spouse of President Lee Jae-myung, has been decided.
The Supreme Court on the 4th assigned Mrs. Kim's violation of the Public Official Election Act case to the 3rd division, consisting of Justices Lee Heung-gu, Oh Seok-jun, Noh Kyung-pil, and Lee Sook-yeon. Presiding is Justice Noh Kyung-pil (Judicial Research and Training Institute class 23).
In August 2021, Mrs. Kim was indicted without detention for allegedly providing meals worth approximately 104,000 won to a total of six people, including three spouses of current and former Democratic Party lawmakers, her driver, and an assistant, at a restaurant in Seoul using a Gyeonggi Province corporate card, during the time when President Lee Jae-myung was serving as the Governor of Gyeonggi Province.
In November last year, the first trial court sentenced Mrs. Kim to a fine of 1.5 million won. The court found that the act of paying for the meal with a corporate card by Mrs. Kim's assistant, Mr. Bae, was effectively done with her acquiescence, and judged the two as accomplices. The second trial held in May this year upheld the first trial's judgment.
Presiding Justice Noh, nominated by Chief Justice Cho Hee-dae and appointed by former President Yoon Seok-yeol, is known for his moderate-conservative stance. He has handled numerous constitutional and administrative law cases while serving as a Supreme Court research judge and is particularly recognized for his expertise in administrative law.
On May 1, Justice Noh was one of the ten Supreme Court justices who delivered a guilty verdict in the full bench's decision to remand the case involving President Lee Jae-myung's violation of the Public Official Election Act during his presidential candidacy.
In April, he also presided over the Supreme Court review that confirmed the acquittal of Son Jun-sung, Deputy Chief Prosecutor of the Daegu High Prosecutors' Office, who was indicted over the so-called 'prosecution service scandal.' At the time, the Supreme Court confirmed the acquittal, in line with the appellate court.
