[Financial News] Yoon Seok-yeol, former President, has applied to the court for a suspension of compulsory execution regarding the first trial ruling that ordered compensation for mental damage to citizens due to the emergency martial law measures of December 3. This is a measure to respond to the 'provisional execution' ruling that allows compulsory execution even before the first trial ruling is confirmed.
According to the Seoul Central District Court on the 30th, Yoon's side applied for a suspension of compulsory execution regarding the first trial ruling that ordered the payment of 100,000 won per citizen. The case was assigned to the Seoul Central District Court's Civil Appeals Division 8-3 (Presiding Judges Shin Young-hee, Jeong In-jae, Kim Ki-hyeon). Yoon's side also submitted an appeal to the first trial court on the same day.
Previously, on the 25th, Presiding Judge Lee Seong-bok of the Seoul Central District Court's Civil Division 2 ruled in favor of the plaintiffs in a damages claim lawsuit filed by 104 citizens against former President Yoon, ordering compensation of 100,000 won per person. The ruling also included a 'provisional execution' order that allows the enforcement of compensation even before the ruling is confirmed. Generally, compulsory execution is only possible after the ruling is confirmed, but the court can allow provisional execution when swift realization of rights is necessary.
A ruling that includes a provisional execution order takes effect immediately upon pronouncement, so even if the losing side appeals, the winning side can begin compulsory execution, such as seizing the opponent's assets, based on the ruling.
In response, Yoon's side applied for a suspension of compulsory execution to prevent provisional execution. If the court accepts this, compulsory execution will be impossible until the specified deadline. Conversely, if not accepted, the effect of provisional execution remains.
A legal source stated, "In most cases, unless there are special circumstances, a decision to suspend compulsory execution is made on the condition of providing collateral, such as depositing a certain amount in cash or submitting a guarantee insurance certificate."
Lawsuits related to martial law damages against former President Yoon are expected to continue. Lawyer Lee Jae-il and the Reform National Movement Headquarters announced that they are recruiting 1,203 plaintiffs to file a lawsuit against former President Yoon, claiming 200,000 won in compensation per person. This group is a supporter organization of the Democratic Party of Korea, which has held rallies urging prosecutorial reform in the past.
They claim that Yoon's side labeled the rallies as 'illegal gatherings' through YouTube and other channels, and made defamatory and threatening remarks, and plan to claim compensation for these actions along with the martial law-related measures.
Lawsuits against former President Yoon and key figures related to martial law are also underway. Attorney Baek Ju-seon of Law Firm Dayul and Attorney Park Hwi-young of Law Firm Huimyeong filed a lawsuit against former President Yoon, former Defense Minister Kim Yong-hyun, and former Martial Law Commander Park An-su, claiming 300,000 won in total per person at the Seoul Central District Court.
Attorney Baek explained on his social media that hundreds of people applied for the plaintiff group within a day of recruitment, and 100 were selected for the first lawsuit. He also announced plans to select plaintiffs for a second lawsuit by August 1 and file an additional lawsuit, with consideration for expanding the claim amount in the future.
