Will not attend unless special prosecutor is excluded...Court "Separate judgment on unconstitutionality claim"
[Financial News] Former President Yoon Seok-yeol has not attended the sedition charge trial twice in a row since being detained. Yoon's side stated that there is an issue with the authority of the special prosecutor (special prosecutor) to maintain the prosecution, and declared that they will not attend unless the special prosecutor is excluded from the trial.
Former President Yoon did not attend the 11th trial on charges including being the head of sedition, held on the morning of the 17th at the Seoul Central District Court Criminal Division 25 (Presiding Judge Ji Gui-yeon).
Yoon's side argued, "The special prosecutor has already been indicted and is maintaining the prosecution by taking over the case from the prosecution under the unconstitutional special prosecutor law in this sedition charge trial, which is unprecedented in the judicial history of the Republic of Korea and severely infringes on the defendant's right to a fair trial."
They continued, "The content currently under investigation by the special prosecutor is closely related in terms of factual identity and prisoner relations with the ongoing sedition and abuse of power case, and is peripheral or incidental," adding, "The special prosecutor further infringes on the defendant's rights by attempting to detain the defendant with unilateral illegal investigations and meaningless arrest measures."
They also stated, "The defendant's health is seriously deteriorating due to detention," and "The defendant will not attend this trial unless the special prosecutor is excluded from this trial."
In response, the special prosecutor's side countered, "Repeated absence while neglecting the duty to attend," and "Consider active measures such as requesting an arrest warrant."
The court stated, "Today will be marked as absent, and materials related to health must be submitted," and "The unconstitutionality issue seems to need to be contested separately."
The court continued the witness examination of Jeong Seong-woo, former head of the 1st department of the Defense Security Command, as an out-of-session evidence investigation.
