[Financial News] The Insurrection and Foreign Affairs Special Prosecutor Team (Special Prosecutor Cho Eun-seok) has suspended the plan to send personnel to the Seoul Detention Center to execute the arrest warrant due to the request for habeas corpus by former President Yoon Seok-yeol.
Special Prosecutor Park Ji-young said at a press briefing on the afternoon of the 16th, "We received a request from the Ministry of Justice in the morning to have the special prosecutor team present on site for the execution of the arrest warrant. We sent an official document stating that Special Prosecutor Park Eok-su would visit, but after confirming that former President Yoon's habeas corpus request was filed with the court at 10:46 a.m., we suspended the on-site command."
The Criminal Procedure Act Article 201-2 stipulates that the period from the day the court receives the arrest warrant application and investigation-related documents and evidence until the day the arrest warrant is issued and returned to the prosecution is not included in the detention period. It is said that the record of the habeas corpus request by former President Yoon was received at 4:37 p.m. that day. Former President Yoon announced that he filed a habeas corpus request with the Seoul Central District Court, claiming that the court's issuance of the arrest warrant was unjust. Habeas corpus is a procedure in which a detained suspect requests the court to re-examine whether their detention is lawful and necessary.
The special prosecutor team notified former President Yoon of the summons for investigation twice on the 11th and 14th, but former President Yoon's side refused, citing health reasons. The special prosecutor team then instructed the head of the Seoul Detention Center to bring former President Yoon to the special prosecutor's office three times on the 14th, 15th, and that day, but all attempts failed.
Special Prosecutor Park further expressed concern that the foreign exchange allegations against former President Yoon were excessively heated, potentially harming national interests. He stated, "The unilateral claims of the accused, which have not been investigated, are being conveyed through the media," and "Foreign exchange is directly related to national interests, and we are well aware of the concerns of the military personnel involved."
