Yoon's side "Substantive and Procedural Illegality Unjust"
[Financial News] The hearing for the case of the review of detention, requested by the side of former President Yoon Seok-yeol, who was re-arrested by the special prosecutor team for rebellion and foreign affairs (Cho Eun-seok special prosecutor), claiming the illegality of the detention, will be held on the 18th.
According to the legal community on the 16th, the Seoul Central District Court Criminal Division 9-2 (Presiding Judges Ryu Chang-seong, Jeong Hye-won, Choi Bo-won) will open the hearing for the review of detention of former President Yoon on the 18th at 10:30 AM in Room 321 of the West Building.
The review of detention is a procedure in which the court determines whether the detention of a suspect is lawful and needs to continue, and usually, the suspect's hearing and evidence investigation must be completed within 48 hours after the request is received. During this period, the investigation of the suspect by the investigative agency is suspended.
The side of former President Yoon announced that they requested a review of detention at the Seoul Central District Court on the morning of that day. The defense team for former President Yoon stated, "We plan to contest the point that the detention is substantively and procedurally illegal and unjust."
Previously, Judge Nam Se-jin, who is in charge of warrants at the Seoul Central District Court, issued an arrest warrant for former President Yoon on the 10th, citing 'concerns about evidence destruction'.
Since then, former President Yoon has been refusing the special prosecutor team's request for attendance, citing health reasons. The special prosecutor team ordered a forced summons to Seoul Detention Center, but it failed twice, and they are attempting the third summons on that day.
