[Financial News] The side of former President Yoon Seok-yeol, who is refusing to be summoned by the special investigation team for rebellion and foreign affairs while in detention, has applied for a detention review to the court.
Former President Yoon's legal team announced on the 16th, "This morning, we submitted the application for the detention review of former President Yoon to the Seoul Central District Court."
They further explained, "The reason is to argue that the detention is substantively and procedurally illegal and unfair, which is the general legal principle of the review."
The detention review is a procedure where the court examines and determines whether the detention of a suspect is lawful and whether there is a need to continue the detention. According to the Criminal Procedure Act, the court must interrogate the suspect and conduct evidence investigation within 48 hours after the application for detention review is submitted. Subsequently, the court must comprehensively re-examine the necessity of detention, such as violation of detention conditions and procedures, risk of evidence destruction, or possibility of escape, before making a decision on release or dismissal.
Former President Yoon was detained on the 10th when Judge Nam Se-jin, who is in charge of warrants at the Seoul Central District Court, issued a warrant citing the "risk of evidence destruction" for the rebellion special investigation team's request for a detention warrant. However, former President Yoon refused to comply with the special investigation team's summons on the 11th and 14th, citing health reasons. The special investigation team ordered forced attendance at Seoul Detention Center, but due to various reasons, including the execution of physical force against former President Yoon, who is a former president, the forced attendance was unsuccessful.
