[Financial News]  The special investigation team for rebellion and foreign exchange (Cho Eun-seok Special Prosecutor) will attempt a second forced summons for former President Yoon Seok-yeol, who refuses to appear.
On the 15th, according to the legal community, the special investigation team issued an order to bring former President Yoon to the investigation room by 2 PM that day to Seoul Detention Center the previous day.
Former President Yoon has refused the special prosecutor's request to appear, citing health reasons since being detained on the 10th.
The special investigation team deemed the reason for non-compliance unjustified and attempted forced summons the previous day, but former President Yoon refused even this, resulting in failure to bring him in.
The special investigation team later expressed regret through a briefing, saying "It is hard to understand," and reissued the order to bring former President Yoon by 2 PM that day.
The likelihood of former President Yoon complying with the forced summons remains slim.
The defense team claims that former President Yoon's health has significantly deteriorated due to diabetes and the poor conditions in the detention center amid the heat, making it impossible for him to comply with the investigation.
Many analyses suggest that since former President Yoon is effectively in a 'boycott of investigation' state, rebelling against the special prosecutor's investigation and the issuance of the arrest warrant, he will not comply with the investigation regardless of his health condition.
It is also difficult to forcibly bring former President Yoon, who is 'holding out,' and make him sit in the investigation room. The special investigation team previously explained in a briefing that "Considering he is a former president, it was difficult to employ coercive physical force."
If the forced summons fails again, the special investigation team may attempt an investigation visit to the detention center. However, the success of this is also uncertain.
Some suggest the possibility of prosecuting former President Yoon without additional investigation.
Previously, in 2018, when former President Lee Myung-bak, who was detained on charges of receiving bribes worth 11 billion won, refused an investigation visit to the detention center, the prosecution eventually proceeded to trial without a face-to-face investigation. The prosecution attempted a visit investigation three times but was refused. The head of the Seoul Central District Prosecutors' Office at the time, who led the investigation, was former President Yoon.
