Civil Servant Accused of 'Misuse of Corporate Card' Not Prosecuted... Why?

[Financial News] A civil servant accused of using business operation budget funds for personal purposes has been cleared of charges.
According to the legal community on the 14th, the Gyeonggi Northern Police Agency decided not to prosecute Mr. A, who was booked last month on the 12th for charges including breach of trust in business, forgery of official documents, and use of forged documents.
Mr. A is accused of using a corporate card for personal purposes a total of 33 times, amounting to approximately 2 million won, while conducting youth-related projects during his tenure as a civil servant from February 2017 to June last year.
He is also accused of forging official documents by arbitrarily stamping the seal of the head of the office and department head without obtaining their approval while preparing the business operation plan for these crimes.
Mr. A denied all charges, claiming he conducted actual work even on holidays such as vacations and childcare time. Mr. A stated, "After receiving treatment during my sick leave, I returned and held meetings with others," and "The use of meeting fees during this process cannot be considered misuse. The seal was also stamped after verbally reporting to the superiors and receiving permission."
The police found insufficient evidence to acknowledge Mr. A's charges. They determined that it could not be concluded that meetings did not take place solely because Mr. A applied for leave.
Jeong Jae-bong, a lawyer from Daeryun Law Firm, who represented Mr. A, explained, "This issue arose because Mr. A used the budget while on annual leave, or because the actual attendees differed from those listed on the budget application," adding, "There may have been some administrative errors such as card usage mistakes or attendee omissions, but it was never a personal use of the budget."
He further stated, "Mr. A merely drafted and submitted the business plan according to requests while conducting the project, and there was no intent or purpose of forgery and use," and "All the budget usage details of Mr. A that were problematic in this case were used appropriately for their actual purposes."
