'Park Won-soon Documentary' Screening Ban... "Compensation of 10 Million Won to Sexual Assault Victim" Court Ruling

[Financial News] The court has ruled that the producers of a documentary film claiming the innocence of the late Park Won-soon, former mayor of Seoul, in a sexual assault case must compensate the victim 10 million won.

Seoul Southern District Court Civil Division 15 (Presiding Judge Yoon Chan-young) ruled partially in favor of the plaintiff in a damages lawsuit filed against Director Kim Dae-hyun, the producer of the film 'First Plea', and the Park Won-soon Documentary Production Committee, 'People Who Believe in Park Won-soon'.

Additionally, a compensation order of 10 million won was issued, along with a screening ban, and a penalty of 20 million won per violation of the screening ban. As a result, it is impossible to screen the film via wired or wireless means, or to provide streaming or download services. Furthermore, third-party production, sale, and distribution activities are also restricted.

The court stated, "The film contains criticism that the plaintiff, influenced by biased women's groups or legal representatives, based on distorted memories, falsely accused the deceased of sexual harassment, leading to his death without any wrongdoing," and "It is reasonable to view the content as significantly degrading the plaintiff's social value or evaluation and seriously infringing on personal rights."

It continued, "The existence of the deceased's sexual harassment acts against the plaintiff has been acknowledged multiple times through thorough investigations by the National Human Rights Commission and related administrative litigation procedures," adding, "It is clear that the plaintiff's personal rights were greatly infringed and they suffered mental anguish due to the defendants' illegal acts, thus they are liable for damages caused by the illegal acts."
