Special Prosecutor Team "Principle of Summoning Investigation"... Suggests Possibility of Compulsory Attendance if Refused Again
[Financial News] The special prosecutor team for rebellion and foreign exchange (Jo Eun-seok Special Prosecutor) has notified former President Yoon Seok-yeol, who refused to appear for the first investigation after being re-arrested, to reschedule the investigation for the afternoon of the 14th, but it is still uncertain whether former President Yoon will attend.
According to the legal community on the 12th, former President Yoon's legal team plans to meet with him at Seoul Detention Center on the morning of the 14th, when the special prosecutor team has requested his appearance, to confirm his intention to attend. However, former President Yoon is complaining of deteriorating health due to diabetes and psychological shock, so it is uncertain whether he will comply with the second appearance request.
Former President Yoon's lawyer stated, "The inside of the detention center is hot, and due to diabetes, former President Yoon eats little, so his willingness to actively testify has significantly diminished compared to before his arrest."
It is reported that former President Yoon's side is also considering applying for a review of the legality of his detention to the court.
The special prosecutor team notified that they would conduct the first investigation at 2 p.m. on the 11th after former President Yoon was re-arrested with a detention warrant issued by the court at dawn on the 10th, but it was canceled as former President Yoon submitted a non-attendance statement and did not comply.
As the special prosecutor team sensed that former President Yoon was unwilling to cooperate with the investigation, they are considering the 'compulsory attendance' card, and the tension between the two sides continues even after the arrest.
Park Ji-young, Special Prosecutor, stated in a briefing on the 11th, "If non-attendance is deemed appropriate, that's one thing, but if not, it will proceed according to the procedures of the Criminal Procedure Act," and "Detention includes confinement and attendance, and in that sense, it means reviewing the next steps."
Regarding the possibility of a detention center visit investigation considering the precedent of former presidents, "The principle is to summon, and there is no plan for a detention center visit investigation," was dismissed. In 2017, former President Park Geun-hye was investigated by the prosecution at Seoul Detention Center four days after her arrest. In the case of former President Lee Myung-bak, the prosecution attempted a visit investigation three times but failed to conduct a face-to-face investigation as all were refused.
