Wemade Wins Appeal in Seoul High Court for 'Legend of Mir 2' Copyright Dispute

[Financial News] The court ruled that the succession of intellectual property (IP) of 'Legend of Mir 2' to WeMade's subsidiary, Electric IP, following its physical division, is legitimate under Chinese law.
According to Wemade on the 11th, the Seoul High Court's 4th Civil Division dismissed the plaintiff Actozsoft's claim and ruled in favor of Wemade in the remand trial of the copyright infringement lawsuit between Wemade and Actozsoft regarding 'Legend of Mir 2'.
This ruling follows the Supreme Court's decision in June 2024 to remand the case, stating that it is necessary to review the applicable law as Chinese law regarding the copyright infringement in China and the succession of copyright to Electric IP following Wemade's physical division.
The court did not recognize Actozsoft's claim of a 50 to 50 royalty revenue distribution ratio, ruling that the revenue from the 'Legend of Mir 2' IP license agreement should be distributed with Wemade receiving 80% and Actozsoft receiving 20%, as per Wemade's existing position.
Wemade has completed the payment of the full amount of approximately 4.5 billion won in royalty distribution calculated based on the existing 80 to 20 distribution standard to Actozsoft, as ruled in the first trial in 2019.
Wemade stated, "The possibility of the long-standing legal dispute between the two companies over the distribution of royalties from mobile games based on the 'Legend of Mir 2' IP in China being finally confirmed in favor of Wemade has increased."
A Wemade representative said, "With this ruling, the long-standing legal dispute between Wemade and Actozsoft is expected to be resolved soon," adding, "The two companies will continue to cooperate in various ways to enhance the value of the Mir IP and pursue business."
