Charged with Violating the Public Official Election Act... Sentenced to 1 Year in Prison, 2 Years Probation
The Supreme Court's 3rd Division (Presiding Judge Noh Kyung-pil) confirmed the original sentence of 1 year in prison and 2 years probation for Ahn, who was indicted for violating the Public Official Election Act, on the morning of the 29th.
The Supreme Court stated, "There is no error in the original judgment that violates the principles of logic and experience, exceeds the limits of free conviction, or misunderstands the principles of clarity in the principle of legality, the establishment of the crime of violating the Public Official Election Act, and the law of joint principal offenders."
Ahn is accused of paying a total of 113 million won to Mr. A, the head of a promotion agency, from June 2021 to January 2022, with the aim of becoming a presidential candidate in the People's Power primary.
The first trial judged Ahn guilty of paying 68 million won to Mr. A and others from June 19, 2021, to October 9, 2021, and sentenced him to 1 year and 6 months in prison with 2 years probation.
The second trial reduced the sentence to 1 year in prison with 2 years probation. It was considered favorable that Ahn was eliminated in the second preliminary primary, which did not decisively affect the primary results, and that Ahn acknowledged his wrongdoing.
The second trial court pointed out, "The defendants improperly intervened in the party primary process, which needs to be conducted through democratic and fair procedures that fully reflect the will of the people and party members," and "They undermined the legislative purpose of the Public Official Election Act, which aims to contribute to the development of democratic politics by preventing election-related corruption."
